About the Author
Philippe Leroux-Martin is a Canadian lawyer who worked for the Office of the High Representative in Bosnia and Herzegovina as a member of a team of legal advisors who oversaw the legal aspects of the Dayton peace agreement implementation. Mr Leroux-Martin also acted as chief legal advisor to the Police Restructuring Commission of Bosnia and Herzegovina chaired by former Belgian Prime Minister Wilfried Martens. Following his work in Sarajevo, he headed the legal department of the International Civilian Office, an organization established to supervise and coordinate Kosovo's accession to independence in 2008-9.

An Illuminating Analysis

In “Diplomatic Counterinsurgency” Philippe Leroux-Martin presents an illuminating theoretical analysis of power and peacemaking and uses it to explain why Bosnia and Herzegovina’s post-war recovery has been brought to a standstill.

He begins with a detailed account of a showdown between the International Community and the Bosnian Serb leadership in 2007. The International Community blinked first, and the prospects for the country and its four million people have not yet recovered.

Leroux-Martin was directly involved in the standoff as a legal adviser and his account is lucid and compelling. He acknowledges the strategic and tactical mistakes that were made, and he examines lessons learned in order to point a way forward.

Recognising that war continues “by other means” during peace implementation and that conflict is “emotional, resilient, and intense”, outsiders need to be prepared when domestic actors – still engaged in conflict but not in open war – eschew pragmatic solutions in favour of obstruction and apparently obscure policy objectives.

Leroux-Martin uses the 2007 crisis to demonstrate that in the absence of a favourable overarching configuration of power, it isn’t possible to make fundamental changes – even universally beneficial ones – to a political settlement simply by means of painstaking and reasonable negotiation.

He offers specific and timely advice to European Union policy makers who have sought a leadership role in the international engagement with Bosnia and Herzegovina. He notes that Brussels has shown a damaging “willingness to dilute its own conditionality” when dealing with Bosnian leaders, and he argues that the EU must address the “profound reluctance” of these leaders “to abandon rigid wartime aspirations”. It must also understand that the accession process “directly interferes with the distribution and allocation of power”.

This is a practical, well-argued – and immensely readable – contribution to understanding and resolving political and diplomatic obstacles to peacemaking, in Bosnia and Herzegovina and elsewhere.

Diplomatic Counterinsurgency is a highly engaging and thought-provoking examination of international involvement in post-conflict Bosnia and Herzegovina, which suggests broader lessons to be drawn from such involvement. The author lifts the curtain on the complicated relationships and interactions between/among domestic and international actors in the country and adds an important (and experienced) voice to ongoing debates concerning peace building and international territorial administration.

This is a fascinating read for international lawyers, policymakers and scholars who work on peace building and international institutions, but it also deserves to be read by a wider audience. Very readable and full of fascinating detail, it provides an insight into the high-stakes negotiations and decision-making that take place after wars are over, peace agreements signed and the world's attention has moved elsewhere.
